
The United States House of Representatives has introduced a resolution urging the Nigerian government to ensure that all legal proceedings involving IPOB leader Nnamdi Kanu comply with the country’s constitution and international human rights standards.
The resolution, submitted by John James and dated April 9, 2026, reflects growing concerns over Kanu’s detention, trial, and imprisonment following his transfer from Kenya to Nigeria in June 2021.
Kanu, leader of the Indigenous People of Biafra (IPOB), was convicted on terrorism-related charges by a Federal High Court in Abuja in November 2025 and sentenced to life imprisonment on several counts, alongside additional concurrent prison terms.
According to the resolution, questions remain about the circumstances surrounding Kanu’s arrest in Nairobi and his subsequent transfer to Nigeria, with legal observers and international bodies raising concerns about compliance with international law.
The lawmakers referenced a July 2022 opinion by the United Nations Working Group on Arbitrary Detention, which concluded that Kanu’s detention violated international human rights obligations and called for his release and appropriate remedies.
The document also noted that Kenyan courts have issued rulings regarding the legality of Kanu’s transfer, while human rights organizations have expressed concerns over due process, access to legal representation, and conditions of detention.
The resolution warned that prolonged detention without adequate medical care could pose serious humanitarian challenges and called for improved treatment and protection of Kanu’s rights while in custody.
In its recommendations, the House urged the Nigerian government to consider the findings of the UN Working Group, guarantee Kanu regular access to legal counsel and medical care, and maintain humane detention conditions.
The resolution further encouraged the U.S. Secretary of State to engage Nigerian authorities on issues relating to due process and detention conditions, while reaffirming America’s commitment to human rights, freedom of expression, and the rule of law worldwide.
